This Privacy Policy describes how information about you is collected, used and disclosed by Eatstro, when you access or use our website.

Eatstro reserves the right to change or modify this Privacy Policy at any time and in our sole discretion. If we make changes to this Privacy Policy, we will provide notice of such changes, by updating this page and updating the “Updated” date at the beginning of this Privacy Policy. We encourage you to review this Privacy Policy whenever you use or access the Site.

Collection of Information

Information You Provide to Us

We collect information you provide directly to us. For example, we collect information when you register for an Eatstro account, sign up for a subscription, participate in any interactive features on the site, subscribe to a newsletter or email list, participate in a survey, contest, promotion or event, order or purchase (either for yourself or for another person) meal ingredients or other products made available through the Site (collectively, the “Products”), apply for a job, communicate with us via third party social media sites, request customer support or otherwise communicate with us.

The types of information we may collect from you include:

(a) Account Information, such as your name, email address, password, postal address, phone number, subscription, delivery and dietary preferences and any other information you choose to provide;

(b) Transaction Information, such as information about the Products you purchase, shipping and delivery information and information related to returns, refunds and cancellations. We may also collect and store limited payment information from you, such as payment card type and expiration date and the last four digits of your payment card number; however, we do not collect or store full payment card numbers and all transactions are processed by our third party payment processor.

(c) Information About Others, such as the names and email addresses of gift recipients when you purchase gifts through the Sites or invite friends or family to try the Sites or Products.

(d) Other Information You Choose to Provide, such as when you participate in a survey, contest, promotion or interactive area of the Sites or when you request technical or customer support.

Information We Collect Automatically

When you access or use the Sites, the types of information we may automatically collect about you include:

(a) Log Information: When you visit the Sites, our servers automatically record certain log file information, such as your Internet Protocol (“IP”) address, operating system, browser type and language, referring URLs, access times, pages viewed, links clicked and other information about your activities on the Sites.

(b) Mobile Device Information: We collect information about the mobile device you use to access or use the Sites, including the hardware model, operating system and version, unique device identifiers, mobile network information and information about your use of our mobile applications. With your consent, we may also collect information about the location of your device and access and collect information from certain native applications on your device (such as your device’s camera, photo album and phonebook applications) to facilitate your use of certain features of the Sites.

(c) Information Collected by Cookies and Other Tracking Technologies: We and our service providers use various tracking technologies, including cookies and web beacons, to collect information about you when you interact with our Sites, including information about your browsing and purchasing behaviour. Cookies are small data files stored on your hard drive or in device memory that help us improve the Sites and your experience, see which areas and features of the Sites are popular, and count visits. Web beacons are electronic images that may be used in the Sites or emails and help deliver cookies, count visits and understand usage and campaign effectiveness.

Information We Collect From Other Sources

We may also obtain information about you from other sources and combine that with information we collect directly. For example, we may collect information about you when you post content to our pages or feeds on third party social media sites, or if you use credentials (e.g., username and password) from a third party site to create or log into your Eatstro account.

(b) Manage your account and send you related information, including confirmations, updates, technical notices, security alerts and support and administrative messages;

(d) Communicate with you about the Sites, Products, recipes, services, offers, surveys, events and other news and information we think may be of interest to you;

(f) Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Eatstro and others;

(g) Personalise and improve the Sites and provide advertisements, content and features that match your profile or interests;

(h) Facilitate contests, sweepstakes and promotions and process and deliver entries and rewards;

(i) Link or combine with information we get from others to help understand your needs and provide you with a better experience; and

We also may share aggregated or de-identified information, which cannot reasonably be used to identify you.

Social Sharing Features

The Site may offer social sharing features and other integrated tools, such as the Facebook, Twitter and Pinterest buttons (e.g., “Like,” “Tweet” and “Pin It”), which let you share actions you take on the Sites with other media. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature.

Advertising and Analytics Services Provided by Others

Interest-Based Ads

We may allow others to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may use cookies, web beacons and other technologies to collect information about your use of the Sites and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. Eatstro takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorised access, disclosure, alteration and destruction. Please understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you supply will not be intercepted while being transmitted to or from us over the Internet. In particular, email sent to or from the Sites may not be secure, and you should therefore take special care in deciding what information you send to us via email.

Your Choices

Account Information

You may update, correct or modify information about you at any time by logging into your online account or by emailing us at info@eatstro.com If you wish to deactivate your account, please log in to your account, and go to the membership page, here you will find a ‘Cancel Account’ button. Please note, you must cancel your account before 10pm Wednesday to ensure you don’t receive delivery the following week. We may continue to store information about you as required by law or for legitimate business purposes.

Location Information

With your consent, we may collect information about your actual location when you use our mobile applications. You may stop the collection of this information at any time by changing the settings on your mobile device, but note that some features of our mobile applications may no longer function if you do so.

Native Applications on Mobile Device

Some features of our mobile applications may require access to certain native applications on your mobile device, such as the camera and photo storage applications (e.g., to take and upload photos) and the phonebook application (e.g., to send invitations to your contacts to try the Sites or Products).

Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Sites.

Push Notifications

We are very excited to welcome you to Eatstro and our Terms of Use (these “Terms”). Please note these Terms are important as they affect your legal rights, so please take time to read them carefully.

By accessing or using our Eatstro website, you agree to be bound by these Terms and all of the terms incorporated herein by reference. If you do not agree to these Terms, you may not access or use ww.eatstro.com, you must also not receive or use the meal ingredients or other products made available through the website (collectively, i.e the “Products”).

These Terms do not alter in any way the terms or conditions of any other agreement you may have with us in respect of any products, services or otherwise. If you are using the Eatstro website on behalf of someone else you represent and warrant that you are authorised to accept these Terms on such entity’s behalf and that such entity agrees to be responsible to us if you or such entity violates these Terms.

Eatstro reserves the right to change or modify these Terms at any time and in our sole discretion. If we make changes to these Terms, we will update this page and update the “Last Updated” date at the beginning of these Terms. By continuing to access or use the website or order, receive or use Products, you confirm your acceptance of the revised Terms and all of the terms incorporated therein by reference. We encourage you to review the Terms frequently to ensure that you understand the terms and conditions that apply when you access or use the Sites or order, receive or use the Products. If you do not agree to the revised Terms, you may not access or use the website or order, receive or use the Products.

2. Service Availability

Our Site is only intended for use by people living in Ireland and Northern Ireland.

3. Eligibility

Our website is not targeted toward or intended for use by anyone under the age of 18. By using Eatstro.com, you represent and warrant that you are 18 years of age or older, have not been previously suspended or removed from using the site, or engaged in any activity that could result in suspension or removal from the site, do not have more than one Eatstro account, and have full power and authority to enter into these Terms and in so doing will not violate any other agreement to which you are a party.

4. Registration, Account and Communication Preferences

In order to access and use certain areas or features of the Site, you will need to register for an Eatstro account. By creating an account, you agree to provide accurate, current and complete account information, maintain and promptly update from time to time as necessary your account information, maintain the security of your password and accept all risks of unauthorised access to your account and the information you provide to us, and immediately notify us if you discover or otherwise suspect any security breaches related to the Site or your account.

By creating an Eatstro account, you also consent to receive electronic communications from Eatstro (e.g., via email or by posting notices to the Site). These communications may include notices about your account (e.g., payment authorisations, password changes and other transactional information) and are part of your relationship with us. You agree that any notices, agreements, disclosures or other communications that we send to you electronically will satisfy any legal communication requirements, including, but not limited to, that such communications be in writing. You should maintain copies of electronic communications from us by printing a paper copy or saving an electronic copy. We may also send you promotional communications via email, including, but not limited to, newsletters, special offers, surveys and other news and information we think will be of interest to you. You may opt out of receiving these promotional emails at any time by following the unsubscribe instructions provided therein.

5. Terms of Sale

5.1. Meal Subscriptions; Continuous Subscriptions; Cancellation Policy

Meal Subscriptions. We offer different subscription plans for our meal ingredients (each, a “Meal Subscription”). For more information about our Meal Subscriptions, please visit the our FAQs.

Continuous Subscriptions. WHEN YOU REGISTER FOR A MEAL SUBSCRIPTION, YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT (A) Eatstro (OR OUR THIRD PARTY PAYMENT PROCESSOR) IS AUTHORISED TO CHARGE YOU ON A WEEKLY BASIS FOR YOUR MEAL SUBSCRIPTION FOR AS LONG AS YOUR MEAL SUBSCRIPTION CONTINUES, AND YOUR MEAL SUBSCRIPTION IS CONTINUOUS UNTIL YOU CANCEL IT OR WE SUSPEND OR STOP PROVIDING ACCESS TO THE SITE OR PRODUCTS IN ACCORDANCE WITH THESE TERMS. YOU MAY SKIP YOUR WEEKLY MEAL ORDER AS OFTEN AS YOU WOULD LIKE BY MANAGING YOUR DELIVERY SCHEDULE ON YOUR DELIVERY SCHEDULE PAGE.

Cancellation Policy. IN ORDER TO CANCEL YOUR MEAL SUBSCRIPTION, YOU MUST: Log into your account, and go to the membership page, here you will find a ‘Cancel Account’ button. Please note, you must cancel your account before 10pm Wednesday to ensure you don’t receive delivery the following week. We may continue to store information about you as required by law or for legitimate business purposes.

In the event you cancel your Meal Subscription, please note that we may still send you promotional communications about Eatstro, unless you opt out of receiving those communications by following the unsubscribe instructions provided therein.

5.2. Gifts

You have the ability to purchase subscriptions for other people by contacting us at info@eatstro.com, we will soon offer various Gift packages, so please contact us for more information.

5.3. Discounted & Free Trials

From time to time, to the extent legally permitted, we may offer discounted & free trials of certain subscriptions for specified periods of time with a discounted payment or without payment. If we offer you a trial, the terms of your trial will be provided in the marketing materials describing the particular trial or at registration.

ONCE YOUR TRIAL ENDS, WE (OR OUR THIRD PARTY PAYMENT PROCESSOR) WILL BEGIN BILLING YOUR DESIGNATED PAYMENT METHOD ON A RECURRING BASIS FOR YOUR SUBSCRIPTION (PLUS OTHER CHARGES) FOR AS LONG AS YOUR SUBSCRIPTION CONTINUES, UNLESS YOU CANCEL YOUR SUBSCRIPTION PRIOR TO THE END OF YOUR TRIAL. INSTRUCTIONS FOR CANCELING YOUR SUBSCRIPTION ARE DESCRIBED IN SECTIONS ABOVE. PLEASE NOTE THAT YOU WILL NOT RECEIVE A NOTICE FROM US THAT YOUR TRIAL HAS ENDED OR THAT THE PAID PORTION OF YOUR SUBSCRIPTION HAS BEGUN. WE RESERVE THE RIGHT TO MODIFY OR TERMINATE TRIALS AT ANY TIME, WITHOUT NOTICE AND IN OUR SOLE DISCRETION.

PAID, FREE TRIAL OFFERS AND DISCOUNTS ARE LIMITED TO A MAXIMUM OF ONE TRIAL PER HOUSEHOLD.

5.4. Payment and Billing Information

By providing a credit card or other payment method that we accept, you represent and warrant that you are authorised to use the designated payment method and that you authorise us (or our third party payment processor) to charge your payment method for the total amount of your subscription or other purchase (including any other charges) (collectively, as applicable, an “Order”). If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be suspended or cancelled. You must resolve any problem we encounter in order to proceed with your order. In the event you want to change or update payment information associated with your Eatstro account, you can do so at any time by logging into your account and editing your payment information.

You acknowledge that the amount billed may vary due to promotional offers, changes to your Meal Subscription or changes in applicable other charges, and you authorise us (or our third party payment processor) to charge your payment method for the corresponding amount.

5.5. Pricing and Availability

All prices are shown in Euro and other charges, if any, are included. We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice; provided, however, that if we change the amounts or other charges associated with your Meal Subscription, we will provide advance notice of such changes. The shipment of meal ingredients as applicable, to you after our delivery of such notice will confirm your acceptance of such changes, unless you cancel your subscription in accordance with the cancellation policies set forth in Sections above as applicable.

All of our Products are subject to availability, and we reserve the right to impose quantity limits on any Order, to reject all or part of an Order, to discontinue offering certain Products and to substitute Products (including, but not limited to, specific meal ingredients or entire meals) without prior notice. We strive to provide you with high-quality Products, and given the perishable nature of certain Products and market conditions beyond our control, we may be required to make substitutions from time to time.

5.6. Shipping and Handling

You agree to pay any shipping and handling charges shown at the time you make a purchase. We reserve the right to increase, decrease, add or eliminate shipping and handling charges from time to time, but we will provide notice of the charges applicable to you before you make your purchase. Generally, shipping is handled by a third party courier.

5.7. Deliveries

You are responsible for inspecting all Products you receive from us for any damage or other issues upon delivery. In addition, you are solely responsible for determining the freshness of the Products you receive. You should always inspect your delivery to confirm that the meal ingredients arrive in a cool, refrigerated condition. We recommend that you use a thermometer to ensure that the temperature zone within the container in which any meat, poultry or seafood Product is located is 5C or below. In the unlikely event that such temperature zone is above 5C, or you have any other reason to believe that any other Product in your delivery is not suitable for consumption, contact us at info@eatstro.com and discard the item. To maintain the quality and integrity of the Products, we recommend that you immediately refrigerate all perishable Products upon delivery. From the time of delivery, the condition and consumption of the Products are solely at your risk, and you are solely responsible for the proper and safe washing, handling, preparation, storage, cooking, use and consumption of the Products following delivery.

If you are not at home when your meal delivery arrives, the courier will generally call you or leave the box in a secure location. Our meal ingredients are packaged with insulated liners and gel packs and will typically remain cold and fresh for several hours, but depending on the season and temperature at the time of delivery, advance planning by you should be made for proper storage of your meal ingredients prior to consumption. In certain areas, you may be able to provide additional delivery instructions when setting up your Eatstro account, such as requesting that your delivery be left in a nearby shop or with a neighbour. Any individual at the delivery address who accepts a delivery from us is presumed to be authorised to receive such delivery. In cases in which you have designated an alternative receiver, such person shall accept the delivery under all of the same terms and conditions that would apply had you accepted the delivery yourself.

5.8. Returns and Refunds

If you are dissatisfied with a meal or meal ingredient for any reason, please contact us at info@eatstro.com within seven (7) days of the date you received the meal ingredients and we will either replace the meal or meal ingredient at our expense or, depending on the circumstances, provide you a full or partial credit or refund of the purchase price for that meal or meal ingredient. We may require the return or photographic documentation of any meal ingredient with which you are dissatisfied before we provide you a replacement, credit or refund.

6. RISK AND TITLE

The Products will be at your risk from the time of delivery. Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges. To maintain the integrity of products after delivery, we recommend that you immediately refrigerate or freeze perishable items.

7. License to Access and Use Our Sites and Content

Unless otherwise indicated in writing by us, the Site and all content and other materials contained therein, including, without limitation, the Eatstro logo and all designs, text, graphics, pictures, information, data, software, sound files, User Content, other files and the selection and arrangement thereof (collectively, “Content”) are the proprietary property of Eatstro or our licensors or users, as applicable, and are protected by international copyright laws.

You are hereby granted a limited, nonexclusive, nontransferable, non-sub licensable license to access and use the Site and Content. However, such license is subject to these Terms and does not include any right to sell, resell or use commercially the Sites or Content, distribute, publicly perform or publicly display any Content, modify or otherwise make any derivative uses of the Sites or Content, or any portion thereof, use any data mining, robots or similar data gathering or extraction methods, download (other than the page caching) any portion of the Sites or Content, except as expressly permitted by us, and use the Site or Content other than for their intended purposes. Any use of the Site or Content other than as specifically authorised herein, without our prior written permission, is strictly prohibited and will terminate the license granted herein. Such unauthorised use may also violate applicable laws, including, without limitation, copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated by us, nothing in these Terms shall be construed as conferring any right or license to any patent, trademark, copyright or other proprietary rights of Eatstro or any third party, whether by estoppel, implication or otherwise. This license is revocable at any time.

Notwithstanding anything to the contrary in these Terms, the Sites and Content may include software components provided by Eatstro or a third party that are subject to separate license terms, in which case those license terms will govern such software components.

8. Third Party Content

We may display content, advertisements and promotions from third parties through the Sites or in shipments with Products (collectively, “Third Party Content”). We do not control, endorse or adopt any Third Party Content, and we make no representations or warranties of any kind regarding such Third Party Content, including, without limitation, regarding its accuracy or completeness. You acknowledge and agree that your interactions with third parties providing Third Party Content are solely between you and such third parties, and that Eatstro is not responsible or liable in any manner for such interactions or Third Party Content.

9. Disclaimers

YOU ARE SOLELY RESPONSIBLE FOR THE PROPER AND SAFE WASHING, HANDLING, PREPARATION, STORAGE, COOKING, USE AND CONSUMPTION OF THE PRODUCTS YOU RECEIVE FROM US. YOU ARE ALSO SOLELY RESPONSIBLE FOR KNOWING ABOUT ANY FOOD ALLERGIES YOU MAY HAVE AND VERIFYING THE PRODUCTS AND THEIR CONTENTS BEFORE HANDLING, PREPARING, USING OR CONSUMING SUCH PRODUCTS. FURTHER, YOU UNDERSTAND, ACKNOWLEDGE AND AGREE THAT WE STORE, PORTION AND PACKAGE PRODUCTS CONTAINING ALL EIGHT (8) MAJOR ALLERGENS (MILK, WHEAT, EGG, SOY, FISH, SHELLFISH, PEANUTS AND NUTS) AND CANNOT GUARANTEE THAT CROSS-CONTAMINATION WILL NOT OCCUR BETWEEN PRODUCTS.

WE ATTEMPT TO DISPLAY THE PRODUCTS AND OTHER MATERIALS AND INFORMATION YOU VIEW ON THE SITES, INCLUDING PRICING AND NUTRITIONAL INFORMATION, AS ACCURATELY AS POSSIBLE. HOWEVER, WE DO NOT GUARANTEE THE ACCURACY OF SUCH MATERIALS AND INFORMATION AND ARE NOT RESPONSIBLE FOR ANY CLAIMS ARISING OR RESULTING FROM YOUR RELIANCE THEREON. IN THE EVENT OF AN ERROR ON OUR SITES, IN AN ORDER CONFIRMATION, IN PROCESSING OR DELIVERING AN ORDER OR OTHERWISE, WE RESERVE THE RIGHT TO CORRECT SUCH ERROR AND REVISE YOUR ORDER ACCORDINGLY (INCLUDING CHARGING THE CORRECT PRICE) OR TO CANCEL YOUR ORDER AND ISSUE YOU A REFUND. YOU FURTHER AGREE THAT THE PRODUCTS AND OTHER MATERIALS YOU RECEIVE IN YOUR ORDER MAY VARY FROM THE PRODUCTS AND MATERIALS DISPLAYED ON THE SITES DUE TO A NUMBER OF FACTORS, INCLUDING, WITHOUT LIMITATION, SYSTEM CAPABILITIES AND CONSTRAINTS OF YOUR COMPUTER, MANUFACTURING PROCESS OR SUPPLY ISSUES, THE AVAILABILITY AND VARIABILITY OF PRODUCTS, DISTINCT COOKING OR OTHER PREPARATION METHODS AND VARIABILITY OF COOKING EQUIPMENT AND APPLIANCES. THE SITES MAY CONTAIN INFORMATION ABOUT PRODUCTS THAT ARE NOT AVAILABLE IN EVERY LOCATION. A REFERENCE TO A PRODUCT ON THE SITES DOES NOT IMPLY OR GUARANTEE THAT IT IS OR WILL BE AVAILABLE IN YOUR LOCATION OR AT THE TIME OF YOUR ORDER.

EXCEPT AS MAY BE PROVIDED IN A WARRANTY BY THE MANUFACTURER OF A PRODUCT, ALL PRODUCTS AND THE SITES AND CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. EATSTRO DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AS TO THE SITES, CONTENT AND PRODUCTS, ANY WARRANTIES THAT ARISE FROM TRADE USAGE OR CUSTOM, AND ANY WARRANTIES THAT THE SITES OR PRODUCTS WILL BE FREE AND CLEAR FROM ANY ADVERSE LIEN OR SECURITY INTERESTS.

We reserve the right to change any and all Content and to modify, suspend or stop providing access to the Site (or any features or functionality of the Sites) and the Products at any time without notice and without obligation or liability to you. Reference to any products, services, processes or other information by trade name, trademark, manufacturer, supplier, vendor or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by us. Some jurisdictions do not allow the disclaimer of implied terms in contracts with consumers, so some or all of the disclaimers in this section may not apply to you.

We reserve the right in our sole discretion to modify, suspend or discontinue, temporarily or permanently, the Site (or any features or parts thereof) or the provision of the Products at any time and without liability therefor.
